1. Acceptance of Terms

By accessing and using Places2Swim ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Places2Swim is a platform that helps users discover and share information about swimming pools worldwide. The Service includes:

• A searchable database of swimming locations
• User-generated content including reviews, photos, and ratings
• Interactive maps and location-based services
• Information about swimming teams and clubs
• Community features for swimmers

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept all responsibility for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in activities harmful to the Service or other users.

3.3 Deleting Your Account

You can delete your account at any time from your account Settings. Deleting your account permanently removes your account and sign-in details, your saved favorites, and your swim logs.

Deleting your account does not remove the content you contributed. Reviews, ratings, photos, travel tips, and suggested listings or corrections remain on the Service under the license in section 4.2. When you delete your account, we remove your name and email address from that content and show it as Anonymous. If your email address is not verified, we cannot tell which content is yours, so verify it before deleting your account, or contact us. We do not edit the content itself, so text you wrote that identifies you, such as a name typed into a review, remains unless you ask us to change it. Messages you sent through our Contact form are kept as correspondence with the Places2Swim editors.

4. User Content

4.1 Your Responsibilities

You are solely responsible for the content you post on Places2Swim. You agree not to post content that:

• Is false, misleading, or inaccurate
• Infringes on intellectual property rights
• Contains malicious code or viruses
• Is defamatory, obscene, or offensive
• Violates any applicable laws or regulations
• Violates the privacy or publicity rights of others

4.2 License to Your Content

By posting content on Places2Swim, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content in connection with the Service. This license continues after you delete your account.

4.3 Content Moderation

We reserve the right to remove any content that violates these Terms of Service or is otherwise objectionable, without prior notice.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Places2Swim and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

7. Location Services

The Service may use location data from your device to provide location-based features. You can control location permissions through your device or browser settings. We do not store your precise location without your explicit consent.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Places2Swim. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Places2Swim does not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Information on the Service is accurate, complete, or reliable

10. Limitation of Liability

In no event shall Places2Swim, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

11. Indemnification

You agree to defend, indemnify, and hold harmless Places2Swim and its licensees and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of and access to the Service or your violation of these Terms of Service.

12. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
